Terms and Conditions

About these Terms and Conditions

In these terms and conditions "we" and "us" mean Rachael Ree Invitations & Stationery ABN 56 038 297 977 and "you" means you the client. Please read these terms and conditions carefully before purchasing. By placing an order you agree to accept these terms and conditions. No other terms and conditions will apply and these terms and conditions cannot be varied unless we agree to vary them in writing or by email.

Legal Capacity to Transact

If you are under the age of eighteen (18) years you cannot place an order with Rachael Ree Invitations & Stationery. By accepting these terms and conditions you acknowledge that you are over the age of eighteen (18) years. Should Rachael Ree Invitations & Stationery suffer any damage or other losses as a result of a transaction entered into by a minor, Rachael Ree Invitations & Stationery reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Rachael Ree Invitations & Stationery.

Payment Methods

Rachael Ree Invitations & Stationery currently accepts PayPal, Visa, MasterCard and American Express. Full payment is required when you place an order.

Discount Codes

Rachael Ree Invitations & Stationery in its absolute discretion may from time to time provide discount coupons to existing and/or new customers. Discount codes can only be used towards the payment of products on our website. The following terms and conditions apply:

  • A discount code must be entered before completing checkout.
  • Discount codes cannot be applied to previously placed orders.
  • Discount codes are not transferable or redeemable for cash or credit
  • Each promotional code can be used only once.
  • Where a coupon is used towards the payment of a product (or products), an outstanding balance due on the product (or products) must be paid via PayPal, Visa, MasterCard or American Express.
  • If you violate any of the Terms and Conditions, the code will be invalid and the discount will not apply.

Proofing

A digital design proof will be emailed to you 1-2 business days after you have submitted your order. When you receive your proof you will need to thoroughly check that all wording, spelling and details are correct. At this point you can request changes to be made. You will receive 2 sets of changes at no additional cost. If your proof requires more changes than this, you will be charged a fee of $15 per set of changes. The fee is to be paid before we complete the changes. You will then be asked to send an approval email which allows us to proceed with printing. Thoroughly check all details, wording, spelling, punctuation and grammar before you approve the design proof.

Delivery Of Your Products

Production typically takes 2-3 business days after the digital design proof has been approved. All items are shipped from Sydney metropolitan area and we use Australia Post to deliver your goods. Delivery times vary depending on our location within Australia. The estimated delivery times are as follows:

Sydney - 2 days
Melbourne - 4 days
Brisbane - 4 days
Adelaide - 4 days
Perth - 6 days
Canberra - 2 days

The estimated delivery times are in business days (Monday through Friday) excluding Public holidays. Every effort is made to ship your order according to the estimated delivery time, however, we do not guarantee that your goods will be delivered within this time frame. Delivery times may change due to changes in supply or circumstances beyond our control. Title and risk of loss to all products will pass to you on delivery. If your product has not arrived after the estimated delivery time please contact us.

International Shipping

All international orders are dispatched via Australia Post. Shipping times vary depending on your location. Please note that additional customs and tax charges may be applied in your country. Additional charges for customs clearance must be borne by you. Unfortunately we have no control over these charges and cannot predict what they may be. We are unable to reimburse any costs incurred regardless of the circumstances.

Images and Material Submitted by You

Any materials submitted by you, including (without limitation) photographs, images, text, graphics and other materials (collectively, "User Submitted Materials") are subject to the following terms and conditions:

  • You will retain ownership of such User Submitted Materials, and you grant Rachael Ree Invitations & Stationery and its designees a worldwide, non-exclusive, transferable, royalty-free, perpetual irrevocable right and license, with right of sublicense (through multiple tiers), to use, reproduce, distribute (through multiple tiers), create derivative works of and publicly display such User Submitted Materials solely in connection with the provision or production of any product or service by Rachael Ree Invitations & Stationery.
  • You represent and warrant that you own or otherwise possess all necessary rights with respect to the User Submitted Materials, and that the User Submitted Materials do not and will not infringe, misappropriate, use or disclose without authorization or otherwise violate any copyright, trade secret right or other intellectual property or property right of any third party, and that the User Submitted Materials are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable.
  • None of the User Submitted Materials will be subject to any obligation of confidentiality, attribution or otherwise on our part or on the part of any of our assignees, sublicensees or designees, and neither we nor our assignees, sublicensees or designees will be liable for any use or disclosure of any such User Submitted Materials.
  • You agree that we may (but are not obligated to) filter any User Submitted Materials (including, without limitation, deleting or replacing expletives or other harmful or offensive language), alter or refuse to use any User Submitted Materials (including, without limitation, suspended processing and shipping of any order relating to any User Submitted Materials) and/or disclose any User Submitted Materials and the circumstances surrounding the use thereof, to any third party in order to provide the applicable products or services, to protect ourselves or our affiliates, distributors, partners, licensors or other third parties, to comply with legal obligations or governmental requests, or for any other reason or purpose.

You agree to indemnify and hold Rachael Ree Invitations & Stationery and its directors, officers, shareholders, employees, consultants, agents, representatives, affiliates, distributors, partners, licensees, producers, manufacturers and third party users harmless from and against any and all claims, liabilities, causes of action, damages, losses and expenses (including, without limitation, attorneys' fees) that arise directly or indirectly out of or from: (i) your breach of these Terms, any other agreement or terms of use with Rachael Ree Invitations & Stationery and any representation or warranty contained herein or therein; (ii) your User Submitted Materials; and/or (iii) your activities in connection with obtaining any products or services from Rachael Ree Invitations & Stationery.

Errors

Rachael Ree Invitations & Stationery cannot be held responsible for any errors noticed after the design proof has been approved. It is the client's responsibility to carefully check that all details, spelling, wording and grammar is correct before approving the proof. Should any errors be found after the client has approved the proof, the products can be reprinted at the client's expense. The reprint will be placed in the print cue at the time of second approval and will not be prioritised over other customer orders. Should any errors occur after approval that differ from the approved design proof, your order will be corrected, printed and delivered at no charge. 

Prices

All prices are subject to change without notice.

Currency

All prices are in Australian dollars (AUD) unless specified otherwise.

Cancellations

Rachael Ree Invitations & Stationery is a service based business. All of our products are made to order. As soon as you have submitted your order the proofing stage commences. Should you wish to cancel an order during the proofing stage a $50.00 cancellation fee will apply. Orders cannot be cancelled after the design proofs have been approved. We encourage you to purchase a sample before ordering so you can see the high quality of our products.

 

Refunds and Returns

Rachael Ree Invitations & Stationery will provide a refund or reprint the product at our own cost under the following circumstances:

  • Production error such as blurred lettering or insufficient ink application.
  • The printed design is different from the digital design proof that was approved by the client.
  • Product delivered is different from the one ordered.

We will make arrangements with you for the return of the product. The delivery time for replacing the product will be the same as stated for the original product. 

We highly recommend you order a sample invitation before placing an order to ensure you are completely happy with the quality of our invitations. If for some reason you are unhappy with the quality of our invitations and did not order a sample first, Rachael Ree Invitations & Stationery will hold no responsibility to provide you with a refund.

Damaged in Transit

A product is considered damaged or faulty when it is discovered to be damaged or broken when first taken from its packaging. Rachael Ree Invitations & Stationery will provisionally determine whether the product is damaged. The quickest way to do this is to send us an email and attach a few photos of the damage. Where a product is provisionally determined as damaged we will arrange to replace the damaged product. Refunds will only be offered where a replacement product cannot be provided. Where Rachael Ree Invitations & Stationery has provisionally determined that a product is damaged, return shipping will be arranged at the expense of Rachael Ree Invitations & Stationery.

If the product is deemed by us NOT to be damaged, Rachael Ree Invitations & Stationery may in its absolute discretion refuse to replace the product or offer you a refund for the product. When a product is replaced, your replacement product becomes your property and the returned damaged product becomes our property. When a refund is given, the returned damaged product becomes our property. If the condition of the product was misrepresented to us by the customer, Rachael Ree Invitations & Stationery will impose a $30 handling and administration fee.

Time Frame for Returns

You have 14 days to notify Rachael Ree Invitations & Stationery of an issue regarding a delivery. Please open and inspect your items in detail and notify us if there are any issues.

Colours

The colours shown on the website will be slightly different to the colours of the printed product. This is due to variances with screen resolutions and calibrations. We encourage you to purchase a sample before placing an order to ensure you are happy with the colours. Slight shade variations can occasionally occur in different stock batches. We recommend that you order all required items at the same time to ensure no colour variations occur between batches.

Our Liability

Rachael Ree Invitations & Stationery will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.

Credit Card Fraud

Rachael Ree Invitations & Stationery will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

Copyright

All designs on this site are the sole property of Rachael Ree Invitations & Stationery and are covered by copyright. They may not be reproduced in any fashion without the permission of Rachael Ree Invitations & Stationery. Any breach of copyright will be pursued. 

Rachael Ree Invitations & Stationery reserves the right to reproduce any part of any work produced by Rachael Ree Invitations & Stationery for marketing purposes. Unless strictly instructed otherwise by a customer prior to placing an order, Rachael Ree Invitations & Stationery reserves the right to use any design created for a customer as samples and can photograph this stationery for advertising in print, online wedding directories, across social media and throughout website galleries.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.

BY ORDERING PRODUCTS OR USING SERVICES, OR BY OTHERWISE INDICATING ACCEPTANCE OF THESE TERMS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND REVIEWED THESE TERMS IN THEIR ENTIRETY, YOU AGREE TO THESE TERMS, AND THESE TERMS CONSTITUTE BINDING AND ENFORCEABLE OBLIGATIONS TO YOU.
